These Terms and Conditions ("Terms") govern your access to and use of the ArenaX Pro a Casual gaming and Esport service (the "Service") provided by Scancom PLC, trading as MTN Ghana ("MTN Ghana", "MTN", "we", "us" or "our"), together with its authorised technology, content, gaming and service partners.
By accessing, subscribing to, registering for, or participating in the Service, including any games, esports challenges, tournaments, competitions, subscriptions, rewards or related content, you acknowledge that you have read, understood and agreed to these Terms.
If you do not agree with these Terms, you should not subscribe to, access or participate in the Service.
The Service is available to eligible MTN Ghana customers who meet the applicable requirements for participation.
Unless otherwise specified for a particular casual game, competition, tournament, challenge or promotion:
MTN Ghana reserves the right to verify the age, identity, eligibility and authenticity of any participant.
By subscribing to or using the Service, you confirm that:

The specific features available may change from time to time.
Certain games, esports titles, content and services may be provided by third-party publishers, developers, licensors or technology partners.
Such third-party games may be subject to additional terms, conditions, privacy policies, age restrictions and rules imposed by the relevant game publisher.
Participants are responsible for complying with the applicable rules of each game publisher.
For each tournament or Challenge rules specific to the publisher’s title or game format may apply and this shall be available on the ArenaX Pro service portal.
The availability of particular games, content, challenges, tournaments or features may vary depending on:
MTN Ghana does not guarantee that every game, title, feature or tournament will be available at all times.
The Service may be offered through different subscription plans, including:
The applicable price for each subscription will be communicated to you before or at the time of subscription.
The subscription paid provides you to access to the ArenaX Pro platform where all Casual Games, Esport Challenges and Tournaments can be played for FREE along with the all the features offered on the ArenaX Pro portal.
Daily subscription is priced at 1.50 Ghana Shilling.
The service is auto renewal / recurring billing. That is, the subscriber once subscribed shall continue to be billed daily until such time as the subscriber unsubscribes from the service.
All applicable charges will be communicated through the relevant MTN Ghana channels or Service platform.
MTN Ghana reserves the right to change subscription prices, provided that any changes are communicated in accordance with applicable law and regulatory requirements.
Your subscription becomes active once the applicable subscription request has been successfully processed and the applicable charge has been deducted or otherwise successfully collected.
Unless otherwise stated, subscriptions may automatically renew at the applicable frequency until cancelled.
By subscribing to a recurring service, you authorise MTN Ghana and/or its authorised billing partner to deduct the applicable subscription fee from your available MTN account balance or other supported payment method.
You may cancel your subscription using the cancellation method communicated by MTN Ghana for the Service.
Cancellation will prevent future subscription charges, subject to the applicable cancellation rules.
Where applicable, cancellation may not result in a refund of a subscription charge that has already been successfully processed.
Depending on the Service, payment may be made using supported MTN Ghana payment methods, which may include:
By subscribing to the Service, you authorise MTN Ghana and/or its authorised service provider to charge the applicable subscription fee using the selected payment method.
Where the applicable subscription charge cannot be fully collected due to insufficient funds or airtime, MTN Ghana may, where technically and commercially applicable, attempt to collect the charge again or apply a reduced or partial charge.
A subscription may remain active or renew only where the applicable billing transaction is successfully completed.
MTN Ghana may retain records of transactions, subscriptions and payments for operational, customer service, accounting, audit, regulatory and legal purposes.
Refunds may be considered in accordance with MTN Ghana's applicable refund policy and applicable Ghanaian law.
Refund requests should be submitted through the designated MTN Ghana customer support channels within three (3) days of the relevant transaction, unless a longer period is required by applicable law or otherwise determined by MTN Ghana.

Where a refund is approved, MTN Ghana will determine the appropriate refund method in accordance with its applicable procedures and the payment method originally used, subject to technical and regulatory requirements.
To participate in an esports challenge or tournament, you may be required to:
Participants are responsible for downloading the relevant game and completing any required registration with the game publisher before participating.
This may require the use of mobile data or Wi-Fi.
Participants are responsible for all data costs incurred in downloading, registering for and playing games unless MTN Ghana expressly states otherwise.
NOTE: ArenaX Pro provides the challenges and Tournaments for a Publisher or Esport Title holder.
The Gamer will have to register for the Tournament or Challenge on the portal.
However, the gamer’s will PLAY the game on the publisher app or gaming portal in the lobby as per the instructions on our platform following the terms and conditions and format as stated on our service portal.
LeaderBoard shall be updated in a timeous manner once the game has been completed.
Esports and gaming activities may consume significant amounts of mobile data.
Participants are responsible for ensuring that they have sufficient data, airtime, device capacity, battery power and network connectivity to participate.
MTN Ghana or ArenaX Pro will not be responsible for:

Such rules form part of these Terms for the relevant tournament or competition.
MTN Ghana and/or its authorised tournament partner may determine rankings and results based on the applicable game and tournament rules.
In the event of a dispute concerning scores or rankings, MTN Ghana and/or the authorised tournament organiser may investigate the relevant records and make a final determination, subject to applicable law.
Participants must satisfy all applicable eligibility and verification requirements before a prize can be paid.

MTN Ghana may request information or documentation reasonably necessary to verify a winner's identity and eligibility.

Where applicable, prizes may be paid through supported payment methods, which may include:
Prize payments may take up to fourteen (14) days following successful completion of the required verification process.
MTN Ghana will endeavour, where reasonably possible, to process verified prize payments within seven (7) days.
Actual processing times may vary depending on verification, payment processing, banking or Mobile Money procedures, weekends, public holidays and other circumstances beyond MTN Ghana's reasonable control.
Where permitted by applicable law and the applicable competition rules, transaction or payment-related fees may be deducted from a prize.
Any applicable deductions will be communicated where required.
MTN Ghana reserves the right, subject to applicable law and the rules of the relevant promotion or competition, to:

All intellectual property rights in the MTN Ghana ArenaX Pro Service, including trademarks, logos, software, platform interfaces, graphics, text and other content, belong to MTN Ghana, its licensors or authorised partners.
Third-party games and game-related intellectual property remain the property of the relevant publishers, developers or licensors.
Subject to these Terms, you are granted a limited, non-exclusive, non-transferable and revocable licence to access and use the Service for personal and non-commercial purposes.
You may not copy, modify, reproduce, distribute, sell, sublicense or commercially exploit the Service or its content without prior written authorisation.
Where the Service permits users to upload, submit or share content, you retain ownership of your content, subject to any rights granted to MTN Ghana and ArenaX Pro, its authorised partners or the relevant platform provider.
By submitting content, you grant the relevant parties a non-exclusive, royalty-free licence to use, reproduce, display and distribute the content for the purposes of operating, promoting and administering the Service, subject to applicable law.
You agree not to:
You are responsible for maintaining the confidentiality and security of your account information, passwords, PINs and other authentication credentials.
You must immediately notify MTN Ghana if you suspect that your account, password or PIN has been compromised.
You remain responsible for activity carried out using your account or credentials to the extent permitted by applicable law.
MTN Ghana will not be responsible for unauthorised access resulting from your failure to safeguard your credentials.
You must not share your account credentials with another person where account sharing is prohibited by the Service or applicable competition rules.
MTN Ghana may suspend access to the Service where reasonably necessary, including where:
MTN Ghana may terminate access to the Service in accordance with these Terms and applicable law.
Termination or suspension may result in loss of access to certain Service features, subject to any rights the participant may have under applicable law.
MTN Ghana will use reasonable efforts to maintain the Service but does not guarantee that the Service will always be:
MTN Ghana and ArenaX Pro is not responsible for failures, changes, interruptions or limitations caused by third-party game publishers, application stores, payment providers, platforms or other service providers, except to the extent required by applicable law.
The Service may support Android and iOS devices. However, specific games may have additional hardware, software or operating-system requirements.
It is the participant's responsibility to verify that their device meets the requirements of the applicable game before participating.
MTN Ghana will not be liable for delays, interruptions or failures caused by circumstances beyond its reasonable control, including:
To the maximum extent permitted by applicable law, MTN Ghana or ArenaX Pro will not be liable for indirect, incidental, consequential or special losses arising from your use of the Service.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable Ghanaian law.

Where third-party gaming or technology partners are involved, information may be shared with such partners where necessary to provide or administer the Service and as permitted by applicable law.
For questions, complaints, subscription issues, billing matters, refund requests or other Service-related enquiries, customers may contact MTN Ghana through its designated customer support channels.
Customers should provide sufficient information to enable MTN Ghana to investigate the matter, including where relevant:
MTN Ghana may amend, update or modify these Terms from time to time.
Where required by applicable law or regulation, MTN Ghana will provide appropriate notice of material changes.
Continued use of the Service after the effective date of the revised Terms constitutes acceptance of the revised Terms, to the extent permitted by law.
These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Ghana, subject to any mandatory consumer or other statutory rights applicable to the customer.
Any dispute relating to these Terms or the Service should, where reasonably possible, first be referred to MTN Ghana's customer support or designated complaints process for resolution.
Where a dispute cannot be resolved through the applicable complaints process, either party may pursue any remedy available under the laws of Ghana.
Nothing in these Terms limits any statutory right of a consumer to refer a complaint to a competent regulatory authority or other body where such right exists.
These Terms, together with any applicable competition rules, promotional terms, Privacy Policy and other terms expressly incorporated into the Service, constitute the agreement governing your use of the Service.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be effective to the extent permitted by law.
Failure by MTN Ghana to enforce any provision of these Terms does not constitute a waiver of its right to enforce that provision in the future.
You may not transfer or assign your rights or obligations under these Terms without prior written consent from MTN Ghana.
These Terms may be made available in English and/or other languages as MTN Ghana may determine. In the event of any inconsistency, the version required by applicable law or designated by MTN Ghana will apply.
By subscribing to, accessing or participating in the MTN Ghana Premium Gaming & Esports Service, you acknowledge that:
